These Terms cover this website and its sample pages. Use of the GRACE service by a care community is governed by a separate written agreement.
1. Agreement to these Terms
These Terms govern your use of gracefulcheckins.com, including the sample morning board and sample family view pages (together, the “Site”). The Site is operated by kAIndness LLC, a California limited liability company. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
These Terms cover the Site only. Use of the GRACE service itself by a care community is governed by a separate written agreement between that community and kAIndness LLC, and nothing on this Site modifies that agreement or creates one.
2. Not medical advice, not an emergency service
Read this one. The Site describes a scheduled wellbeing check-in service. Nothing on the Site is medical advice, and nothing on it establishes a clinical relationship of any kind. GRACE does not diagnose, treat, or advise on any condition, and GRACE is not an emergency response service. It does not replace staff supervision, nurse-call systems, emergency pendants, or 911. In an emergency, call 911.
3. Sample content on this site
The sample call, the sample morning board, the sample family view, and every resident name, room number, health detail, and figure in them are invented for illustration. They do not describe real people, real conversations, or results achieved for any community. Descriptions of what GRACE does are descriptions of the product’s design and are not a guarantee of any particular outcome for any resident or community.
4. Intellectual property
The Site, its text, layout, graphics, audio, and code, and the GRACE and GRACEful CheckIns names and logos, are owned by kAIndness LLC or its licensors and are protected by intellectual property law. You may view and print pages of the Site for your own evaluation of the service. You may not otherwise copy, republish, or use them commercially without our written permission.
5. Acceptable use
Please do not do any of the following on or to the Site:
- Interfere with or disrupt it, or attempt to gain unauthorized access to it or to any system behind it
- Scrape, harvest, or bulk-download it, or use automated means to overload it
- Reverse engineer or attempt to derive the underlying source of any part of it
- Use it to send unlawful, misleading, or harassing material, or to impersonate anyone
6. Links to other sites
The Site links to The kAIndness Project, our nonprofit counterpart, and may link to other sites. We do not control those sites and are not responsible for their content or their privacy practices. Their terms and policies govern your use of them.
7. Disclaimers
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, kAIndness LLC disclaims all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components, or that any information on it is complete or current.
8. Limitation of liability
To the fullest extent permitted by law, kAIndness LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site, whether based in contract, tort, or any other theory, and whether or not we were advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply to you only to the extent the law permits.
9. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in California, and you consent to the jurisdiction of those courts.
10. Changes
We may update these Terms by posting a new version on this page and changing the date at the top. Your continued use of the Site after a change means you accept the updated Terms.
